The rules for using MQ BOOKS, for buyers and for sellers.

1. Who we are, and what this site is

MQ BOOKS is a marketplace for books, run by MQ BOOKS. Authors, publishers and other authorised sellers list their own books here and sell them directly to you.

We are not the seller. When you buy a book, your contract is with the seller who listed it. We provide the shop, take the payment through our payment providers, deliver digital files, and pass the seller their money. We do not own the stock, we do not ship physical books, and we do not write the books.

2. Your account

You must give accurate details and keep your login to yourself.
You are responsible for what happens under your account.
You can close your account at any time from your account settings. Closing it removes your profile and listings; records we are required to keep, such as completed orders and invoices, are retained as described in our Privacy Policy.

3. Buying

Prices are shown in the currency displayed at checkout and include any taxes stated there.
Payment is taken by Stripe or PayPal. We never see or store your card details.
E-books and audiobooks are delivered immediately. You get a personal download link by email that is unique to your order and expires after 14 days, and the book stays available in My library, where you can also read or listen to it in your browser.
Physical books are posted by the seller, not by us. Your delivery address is sent to that seller so they can send your book. Delivery times are the seller's, and are shown or given to you by them.
An order is accepted when your payment clears and we confirm it. If a book turns out to be unavailable after you pay, you get a full refund.

4. What you may do with a digital book

Buying an e-book or audiobook gives you a personal, non-exclusive licence to read or listen to it for your own use, on your own devices, for as long as we or the seller keep offering it. It does not transfer the copyright.

You may not copy it for other people, upload it anywhere, sell or lend it, strip out any protections, or use it to train a machine-learning model.

Gift codes hand one copy to one person. A code is claimed once, cannot be resold, and may be withdrawn by the seller who issued it if it has not been claimed, or if it was issued in error.

5. Selling

Sellers complete a profile and payout details before listing.
You must hold the rights. By listing a digital file you confirm you are the author, narrator, publisher or rights holder, or are authorised by them. This is the single most important promise a seller makes here.
You are responsible for your listings being accurate, for the content being lawful, and for fulfilling physical orders promptly.
You set your own prices. We take a platform fee of 10% of each sale. The rest goes to your connected Stripe or PayPal account.
We may remove a listing, or suspend an account, where we reasonably believe the rights promise has been broken, the content is unlawful, or these terms have been breached.

6. Content we will not carry

Nothing unlawful, nothing that infringes somebody else's rights, nothing that sexualises children, no material that incites violence or hatred, and nothing deliberately misleading about what a buyer is getting.

7. If you think something here infringes your copyright

Tell us through the contact form on the site, with: what the work is, where it appears on this site, why you believe it infringes, and how we can reach you. We will look into it, and we will take a listing down while we do if the complaint appears substantiated. Sellers whose listings are removed can respond, and we will restore anything taken down in error.

8. Availability

We work to keep the site up and your purchases available, but we do not promise it will never be unavailable. We may change or withdraw features. Where a change materially affects books you have already bought, we will tell you.

9. Liability

Because we are the marketplace and not the seller, we are not responsible for the content, quality or accuracy of the books themselves, nor for a seller's shipping.

To the extent the law allows, our liability to you for anything connected with this site is limited to the amount you paid for the order the claim relates to. We do not exclude liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be excluded.

Your consumer rights come first. If you are in Australia, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those guarantees, or the equivalent rights you have under the consumer law of the country you live in.

10. Changes to these terms

We may update these terms. The date at the top always shows the current version, and we will tell account holders about material changes before they take effect.

11. Law

These terms are governed by the law of Australia, and its courts have jurisdiction — without taking away any right you have to bring a claim where you live.
